REFUND POLICY

This Pop-Up Shops To-Go ("We, Us") Retailer Tenant Refund & Cancellation Policy (“Tenant Refund Policy”) applies to registered Retailer Tenants who have booked and paid for a mobile truck, equipment or A-La Carte service listed on the Pop-Up Shops To-Go website (“Site”) and have a Qualifying Claim related to a Minimum Quality Standard Issue as defined in this Retailer Tenant Refund Policy. It forms part of the Booking Terms and uses capitalized terms defined in the Booking Terms or the Terms of Use.

Minimum Quality Standard Issue

A “Minimum Quality Standard Issue” ("Issue") means any one of the following:

1.1 We cancel a booking last minute (7 days or less before the check-in date of the relevant booking) or

1.2 on check-in, the property: (i) is not generally clean and sanitary; or (ii) contains health and safety hazards that would be reasonably expected adversely to affect the Retail Tenant’s business.

 

Retail Tenant Refund Policy

Pop-Up Shops To-Go will, at its discretion, either:

2.1 refund the RetailTenant part or all of the price paid by the Retail Tenant via the Site depending on the nature of their Qualifying Claim; or

2.2 use its reasonable efforts to find and book another comparable (at Pop-Up Shops To-Go’s reasonable decision) property for any days left in the term of lease.

Changes and Cancellations 

3.1 If Retail Tenants want to change their booking, such Retail Tenants will need to contact and communicate with Us directly on such changes. Retail Tenants should note however that as they have previously agreed and accepted terms in respect of the booking, We are entitled to, and may therefore, charge Retail Tenants additional charges for such changes.

3.2 Retail Tenants can cancel their booking at any time subject to and in accordance with the Cancellation Policy  and payments due under such policy in the event of a cancellation will be deducted from any refund to Retail Tenants and remitted by Us (We will retain our Fees, which are non-refundable).

3.3 Cancellation policies protect both parties in the event of cancellations. The policy will be displayed in the booking summary page and the booking confirmation email. Retail Tenants are advised to carefully read these Terms, the booking summary page and the booking confirmation, particularly in relation to the cancellation policy:

Flexible “1 Week”:

  • Bookings cancelled up to 1 week (7 days) before the start of the lease will receive a 100% refund (after our Fees have been deducted)

  • Bookings cancelled up to 1 day before the start of the lease will receive a 50% refund (after our Fees have been deducted)

  • Cancellations must be made by 12 midday EST (Eastern Standard Time) on the appropriate day.​

Cancellations by Pop Up Shops

We reserve the right to cancel any booking at any time for security, fraud-protection purposes, pursuant to the  Cancellation Policy, or any other reasonable purpose. In such cases the cancellation policies will not apply, a full refund will be made to the card used for the booking.
